Mentor Worldwide LLC Found Liable in Vaginal Mesh Lawsuit in Georgia MDL
Another victory for vaginal mesh victims!
With the favorable results in recent months as far a vaginal mesh litigations are concerned, it would appear that good fortune continues to be showered on vaginal mesh victims.
After finding a mesh manufacturer guilty in a federal court in West Virginia and with the settlement of a couple of lawsuits in West Virginia and New Jersey, another claim was decided in favor of the plaintiff, this time in a District Court in Georgia.
Mentor Worldwide LLC was found liable for the injuries sustained by a complainant after being implanted with a Mentor OB Tape in December 2004 for the repair of the plaintiff’s stress urinary incontinence (SUI).
But this decision was only arrived after some tense moments. The lawyer for the plaintiff had to request the judge for a retrial due to comments made by the defense during its closing statements. Judge Clay D. Land even ruled that the argument of the defendant’s counsel was not improper.
In the end, this concern became unnecessary when the case was settled in favor of the plaintiff.
