Documents Vital to Vaginal Mesh Lawsuits Destroyed by Ethicon, Plaintiffs Allege
Over 600 pounds of documents that were very vital to the vaginal mesh litigation against Ethicon were destroyed by the company, plaintiffs alleged in their motion to Judge Joseph Goodwin of the US District Court for the Southern District of West Virginia. This spoliation of evidence has been described as systematic and carried out over a period of 10 years.
Aside from this, e-mails and records from the computers of key executives of the company, which may have contained safety data about GYNECARE PROLIFT, were also deleted. Even the files of its president, Miss Renee Selman, were not spared from this methodical destruction.
The hard drive of Miss Selman which is believed to contain important information on policies, safety procedures, marketing strategies, and development plans were allegedly erased. Only 25 documents from the files of Miss Selman were presented during pretrial procedures, which experts believe to be very low considering her position and the number of years she served the company.
This has prompted the plaintiffs to request Judge Goodwin to impose severe sanctions against the defendant which include the granting of default judgments to plaintiffs and the elimination of the statute of limitation for all future claims.
